Terms of Service — Luminary

1. Agreement

By purchasing, downloading, or activating the Luminary WordPress theme, you agree to these Terms of Service. If you do not agree, do not purchase or use the product. These terms form a binding agreement between you and JHPS Unlimited.

2. What You Are Buying

Luminary is a WordPress theme that uses artificial intelligence to generate website content, copy, and imagery. Your purchase includes:

  • A license to install and use the Luminary theme on the number of sites permitted by your tier
  • Access to theme updates for the license period
  • The generation credits included with your tier

Your purchase does not include:

  • Anthropic or FAL.ai API access — you must create your own accounts or use managed credits
  • Web hosting or domain registration
  • Ongoing support beyond what is described in Section 7
  • Guaranteed approval of generated content for any specific purpose
  • Ownership of AI-generated images or copy (see Section 5)

Site means a single WordPress installation with a unique domain or subdomain. Installing the theme on a staging or development environment on the same domain does not count as an additional site.

BYOK (Bring Your Own Keys) means you connect your own Anthropic and FAL.ai accounts and are billed directly by those providers. JHPS Unlimited has no visibility into or responsibility for those costs.

Licenses are non-transferable. You may not sell, share, sublicense, or transfer your license key to another person or organization.

4. Generation Credits

Credits are consumed when you successfully generate a website — specifically when the brand generation step completes. Credits are not consumed for failed generations caused by invalid API keys or service outages.

Credits do not roll over between billing periods for the Agency tier. Unused credits expire at the annual renewal date.

Credit packs (+10 credits for $24.90) can be added to any active license at any time by purchasing and activating a separate credit pack key.

JHPS Unlimited reserves the right to adjust credit pricing for future purchases. Credits already purchased are honored at the price paid.

5. AI-Generated Content

Luminary uses Anthropic’s Claude API to generate website copy and FAL.ai to generate images and video. Regarding ownership and responsibility:

You are responsible for reviewing all AI-generated content before publishing. JHPS Unlimited does not review, approve, or warrant the accuracy, originality, or legality of any generated content.

AI-generated images produced via FAL.ai are subject to FAL.ai’s terms of service. Generally, you receive a broad license to use generated images commercially, but you should review FAL.ai’s current terms at fal.ai/terms for the authoritative position.

AI-generated copy produced via Anthropic’s Claude API is subject to Anthropic’s usage policies. You may use the generated copy commercially. Review Anthropic’s current terms at anthropic.com/terms.

You agree not to use Luminary to generate content that is defamatory, fraudulent, deceptive, in violation of any third party’s intellectual property rights, or in violation of Anthropic’s or FAL.ai’s usage policies.

JHPS Unlimited is not liable for any claims arising from AI-generated content produced through the theme.

6. API Keys and Third-Party Services

If you are using BYOK mode or entering your own API keys, you acknowledge:

  • Your Anthropic and FAL.ai API keys are stored encrypted on your own WordPress server using AES-256 encryption
  • JHPS Unlimited never receives, stores, or has access to your API keys
  • You are solely responsible for the security of your WordPress installation and the API keys stored within it
  • You are solely responsible for API costs incurred through your own Anthropic and FAL.ai accounts
  • API pricing is set by Anthropic and FAL.ai and may change without notice — JHPS Unlimited has no control over third-party pricing

If you are using managed credits, JHPS Unlimited uses its own API accounts to process your generation. Your business information (name, description, industry, services) is transmitted to Anthropic and FAL.ai for this purpose. By using managed credits you consent to this transmission.

7. Support

Support is provided via email at info@jhpsunlimited.com. Response time is typically 1–3 business days.

Support covers:

  • Theme installation and activation issues
  • License key activation problems
  • Wizard functionality questions
  • Bug reports for confirmed theme defects

Support does not cover:

  • WordPress hosting configuration
  • Third-party plugin conflicts
  • Custom development or modifications to the theme
  • Anthropic or FAL.ai account issues — contact those providers directly
  • Issues caused by modifications to theme files

JHPS Unlimited reserves the right to decline support for installations that have been significantly modified from the original theme files.

8. Updates

Theme updates are delivered through the Luminary dashboard notification system. You are responsible for applying updates. JHPS Unlimited is not liable for issues arising from failure to update the theme.

Updates are provided at JHPS Unlimited’s discretion. We commit to maintaining WordPress compatibility for major WordPress releases for a minimum of 12 months from your purchase date.

9. Prohibited Uses

You may not:

  • Use Luminary to build websites for resale to clients without a Developer or Agency license
  • Distribute, resell, or share the theme files or license keys
  • Use the theme in a way that violates WordPress.org’s guidelines or any applicable law
  • Reverse engineer, decompile, or create derivative works based on the theme for distribution
  • Use the theme to generate content for spam, phishing, or deceptive purposes
  • Circumvent license validation or credit limits through technical manipulation

Violation of these terms results in immediate license termination without refund.

10. Limitation of Liability

To the maximum extent permitted by law, JHPS Unlimited’s total liability to you for any claim arising from these terms or your use of Luminary shall not exceed the amount you paid for your license.

JHPS Unlimited is not liable for:

  • Loss of revenue, profits, or business opportunities
  • Loss of data from your WordPress installation
  • Downtime of Anthropic or FAL.ai services affecting generation
  • The quality, accuracy, or fitness for purpose of AI-generated content
  • Security issues arising from your WordPress hosting environment
  • Costs incurred through your own Anthropic or FAL.ai accounts

11. Disclaimer of Warranties

Luminary is provided “as is” without warranty of any kind, express or implied. JHPS Unlimited does not warrant that the theme will be error-free, uninterrupted, or that generated content will meet your specific requirements.

AI generation results vary by input. JHPS Unlimited does not guarantee any specific quality, style, or outcome from the AI generation process.

12. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia, United States. Any disputes shall be resolved in the courts of Henrico County, Virginia. If you are located outside the United States, you agree to this jurisdiction.

13. Changes to These Terms

JHPS Unlimited may update these terms at any time. Continued use of the theme after changes are posted constitutes acceptance. Material changes will be communicated via email to your purchase email address where possible.
